Thailand has one of the largest and most active retail trading communities in Southeast Asia, and broker CPA rates for Thai clients run well above the global average. The legal picture is straightforward but often misunderstood. No broker holds a Thai retail forex licence, because the SEC and Bank of Thailand do not issue one, so every broker a Thai trader can use is offshore. Local exchange-control rules push funding through THB bank transfer, PromptPay, e-wallets and USDT rather than card. Regulation in Thailand

Thailand does not license retail forex or CFD brokers for Thai residents. The Securities and Exchange Commission (SEC Thailand) regulates securities and exchange-traded derivatives on the Thailand Futures Exchange (TFEX), while the Bank of Thailand (BOT) controls foreign-exchange activity under the Exchange Control Act. Neither issues a retail OTC forex licence, so no locally licensed retail forex broker exists. Thai traders use offshore-regulated brokers instead, typically under ASIC (Australia), the FCA (UK), CySEC (Cyprus) or FSCA (South Africa). This is the practical reality; we flag it rather than pretend a local licence is on offer. There is no Thai compensation scheme for offshore forex accounts, so recourse runs through the broker's foreign regulator, not a Thai authority.

Tax Note for Thailand

Thai tax residents are taxable on trading profits as personal income on a progressive scale in 2026, from 0% on the first THB 150,000 up to 35% above THB 5 million. A key change matters here: since 1 January 2024, under Revenue Departmental Instructions Por. 161/2566 and Por. 162/2566, foreign-source income (including offshore-broker profits) that a Thai resident brings into Thailand is assessable in the tax year it is remitted, ending the old rule that deferred untaxed offshore income indefinitely. Profits kept offshore and not remitted are treated differently, and the rules are being reviewed, so timing matters. None of this is tax advice, and enforcement on individual offshore-broker profits is still developing, so confirm your own position with a Thai tax adviser before you file.
